Agreement to terms and conditions

These terms and conditions apply to the use of the Department of Commerce's FuelWatch service provided at or from its Web site at http:/www.fuelwatch.wa.gov.au (Service). In using this Service, you agree to be bound by these terms and conditions. If you do not accept these terms and conditions, you must refrain from using the Service.

Please read and ensure that you clearly understand and accept these terms and conditions before you proceed to use the Service. The Department of Commerce reserves the right to change these terms and conditions from time to time at its sole discretion.

Disclaimer

The Department of Commerce does not accept responsibility for any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with your use of this Service, nor does the Department of Commerce accept any responsibility for any such loss arising out of your use of or reliance on information contained or accessed through this Service.

The fuel prices provided at the Service are submitted to the Department of Commerce by third parties. Whilst every effort is made by the Department of Commerce to ensure the accuracy of this information, the Department of Commerce and its suppliers do not warrant that the Service will be uninterrupted or that the information provided through the Service will be timely and free of error or omission. The Department of Commerce does not accept responsibility of loss suffered as a result of reliance by you upon the accuracy or currency of information contained in the Service.

Copyright of all literary and artistic works comprised in the Service is owned or licensed by the Department of Commerce Other than for the purposes of, and subject to the conditions prescribed under, the Copyright Act 1968, you may not in any form or by means:

• adapt, reproduce, store, distribute, display, perform, publish or create derivative works from any part of this Service; or
• commercialise any information, products or services obtained from any part of this Service; without the Department of Commerce's prior written permission. Requests for authorisation should be directed to Department of Commerce.

Restrictions on Use

The provision of this Service is strictly governed by the Petroleum Products Pricing Act (1983).

Unless the Department of Commerce otherwise authorises you in writing, you are provided with access to this Service only for your private and domestic use. Without limiting the foregoing, you may not without the Department of Commerce's written permission on-sell access to this Service or information obtained from this Service.

You are prohibited from using any screen scraping, database scraping, data mining or spidering technology to access the Service or to copy information obtained from the Service without the Department of Commerce's written permission.

Security of data

The Department of Commerce will take all reasonable precautions to protect the Service from misuse and loss and from unauthorised access or copying of information from the Service. Without limitation to the above, the Department of Commerce specifically reserves the right to supply known inaccurate data to those whom it reasonably believes are using the Service in breach of these terms and conditions.

Governing Law and Jurisdiction

These terms and conditions are governed by and will be construed in accordance with the laws of the State of Western Australia and are within the exclusive jurisdiction of the Courts of Western Australia, with the exception of the Copyright Act 1968 which will be construed in accordance with the laws of the Commonwealth of Australia.
